Official Rules and Regulations

Please read carefully.

This Pets Come First Subaru Raffle (“Raffle”) is being conducted by Pets Come First (“PCF”), a 501(c) (3) nonprofit charitable organization. The Raffle is being conducted to raise funds for ongoing charitable purposes.

The Raffle Rules and Regulations (the “Official Rules”) are set forth below. By purchasing a Raffle ticket (a “Ticket”), the purchaser acknowledges that they are aware of and agrees to be bound by these Official Rules and PCF’s interpretation of any such Official Rules.

PCF is responsible for interpreting and applying the Official Rules, and its interpretation and application of such rules shall be final.

Eligibility: Any individual who is 18 years of age or older at the time of the purchase of the Ticket and a resident of the United States is eligible to enter the Raffle.

All federal, state, and local laws and regulations apply.

The Raffle is void where prohibited by law.

How to Enter: Raffle tickets may be purchased online at www.petscomefirst.net/raffle, in-person at the shelter or at participating businesses for $25 for one ticket or five tickets for $100 by eligible persons (see above) until 3000 tickets have been sold.

An individual can purchase as many Tickets as they wish, subject to availability.

Prize Drawings: A representative of PCF will conduct the prize drawing at 8 p.m. on Wednesday, October 23,
2024, at Stocker Subaru in State College, PA.

Entrants need not be present to win. The Winner will be selected at random.

Notification of Winners: The Winner will be notified according to the contact information provided to PCF at the time of Ticket purchase. If a selected winner cannot be contacted or located within one (1) month from the draw date of the applicable raffle drawing, the prize will be deemed to have been donated to PCF.

The IRS has taken the position that amounts paid for chances in raffles, lotteries, or similar drawings for valuable prizes are not gifts, and consequently, the purchase of a Ticket does not qualify as a deductible charitable contribution.

Taxes: Winning a prize in the raffle may have federal, state, and/or local tax consequences. Any and all taxes are the sole responsibility of the winner. Purchasers of Tickets are advised to consult their own tax advisors regarding tax liabilities that may arise from winning a prize in the PCF Raffle.

Terms and Conditions: The Raffle is subject to these Official Rules. These Official Rules cannot be changed by any oral statement made by any employee, consultant or agent acting on behalf of PCF.

By entering the Raffle, entrants accept and agree: (1) to be bound by these Official Rules and the decisions of PCF, which shall be final and binding; (2) waive any right to claim ambiguity in the Raffle or these Official Rules; and (3) that PCF may use the entrant’s name, photograph, likeness, statements, biographical information, voice, and city and state address for promotional or advertising purposes in connection with the Raffle on a worldwide basis and in all forms of media, now or hereafter known, in perpetuity, without review, permission or further compensation, except where prohibited by law. Other rules and regulations may apply.

BY ENTERING PCF’S SUBARU RAFFLE, EACH ENTRANT RELEASES PCF, ITS DIRECTORS, OFFICERS, EMPLOYEES AND AGENTS FROM ANY AND ALL LIABILITY FOR INJURIES, LOSSES OR DAMAGES OF ANY KIND (INCLUDING, WITHOUT LIMITATION, ATTORNEY’S FEES) CAUSED BY PARTICIPATING IN THE RAFFLE OR WINNING ANY PRIZE OR RESULTING FROM ACCEPTANCE, POSSESSION, USE OR MISUSE OF ANY PRIZE, AND EACH WINNER AGREES TO INDEMNIFY AND HOLD PCF HARMLESS FROM ANY AND ALL LOSSES, DAMAGES, RIGHTS, CLAIMS AND ACTIONS OF ANY KIND ARISING FROM, IN CONNECTION WITH, OR AS A RESULT OF PARTICIPATING IN THE RAFFLE OR THE WINNER’S ACCEPTANCE OR USE OF ANY PRIZE.

A RAFFLE ENTRANT’S SOLE AND EXCLUSIVE REMEDY FOR ANY CLAIM AGAINST PCF ARISING OUT OF THE SALE OF TICKETS OR THE CONDUCT OF THE RAFFLE SHALL BE LIMITED TO THE RETURN OF THE PURCHASE PRICE PAID FOR THEIR TICKET(S). IN NO EVENT SHALL PCF, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS OR REPRESENTATIVES BE LIABLE TO ANY PARTY FOR ANY LOSS OR INJURIES TO EARNINGS, PROFITS OR GOODWILL, OR FOR ANY INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES OF ANY PERSON OR ENTITY WHETHER ARISING IN CONTRACT, TORT OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. ANY CONTROVERSY OR CLAIM ARISING OUT OF OR RELATING TO THE RAFFLE OR THESE OFFICIAL RULES SHALL BE SETTLED BY BINDING ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION (PURSUANT TO ITS EXPEDITED PROCEDURES) UNDER ITS COMMERCIAL ARBITRATION RULES AND CONDUCTED IN BURLINGTON, VERMONT. JUDGMENT ON THE AWARD RENDERED BY THE ARBITRATOR MAY BE ENTERED IN ANY COURT HAVING JURISDICTION THEREOF.

Cancellation/Termination of Raffle: By purchasing a Ticket and choosing to participate in the Raffle, each Raffle participant acknowledges and agrees that PCF has the right, in its sole discretion, to elect not to proceed with the Raffle for any reason whatsoever or for no reason, and in such event, a participant’s sole and exclusive remedy shall be to receive a refund of the full price paid by such participant for each Ticket purchased, without interest.

Section 901.743 – Raffle tickets

(a) Tickets for entry into a raffle shall be sold or issued separately, and each ticket shall constitute a separate and equal chance to win compared to other tickets sold or issued. A person may not be required to obtain more than one ticket or to pay for anything other than the ticket to enter a raffle.

(b) Tickets for use in a raffle must have a stub or other detachable section, be consecutively numbered, and be accounted for separately through the use of a log book showing to whom the tickets were given to be sold. The ticket stub or other detachable section of the ticket must bear a duplicate number corresponding to the numbers on the ticket and contain the purchaser’s name, complete address, and telephone number. Both parts must be imprinted with sequential numbers commencing with the number “1” through the maximum number of tickets to be sold or in the case of a raffle where the winner is determined by a drawing conducted by the Department under the State Lottery Law, the universe of eligible ticket numbers must correspond to the universe of eligible numbers in the State Lottery drawing.

(c) A raffle ticket shall be sold for the price stated on the ticket.

(d) A person may not be required to be present at a raffle drawing to be eligible for the prize drawing or to claim the prize awarded.

(e) A ticket seller shall return the stubs or other detachable sections of tickets sold to the eligible organization. The eligible organization shall then place each stub or other detachable section of the ticket sold into a receptacle out of which the winning tickets are to be drawn. The receptacle must be designed so that each ticket placed therein has an equal opportunity with every other ticket to be the one withdrawn.

(f) If a ticket stub or other detachable portion was not placed in the receptacle from which the winners were drawn prior to the drawing, the purchaser must be refunded the purchase price of the ticket.

(g) The purchaser’s name, address and telephone number must appear on the stubs or other detachable section.
